Terms of Use

1. Acceptance of Terms

By accessing or using app.newishtechnology.com (the “Platform”), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with these terms, you must discontinue use of the Platform immediately.

2. Nature of Service

Newish Technology Pvt. Ltd. is a Financial Marketplace and Technology Service Provider. We are not a bank, NBFC, or lender. The Platform enables users to explore, compare, and apply for financial products offered by third-party regulated financial institutions.

Final approval, interest rates, loan amounts, and terms are solely determined by the respective partner banks or NBFCs.

3. Credit Score Authorization

By using our services, you expressly authorize Newish Technology Pvt. Ltd. to act as your authorized representative to obtain your credit information from Credit Information Companies (CICs) such as CIBIL, Experian, or Equifax.

This authorization is valid for the duration required to fulfill your service request and is subject to applicable laws and consent requirements.

4. User Responsibilities
  • You must provide accurate, complete, and up-to-date information
  • You are responsible for maintaining confidentiality of login credentials
  • You agree not to misuse, hack, or disrupt the Platform
  • You shall not engage in fraudulent activities or misrepresentation

Any violation may result in account suspension, termination, and legal action.

5. Device Financing & Enforcement

For financed devices, the Platform may enable enforcement features such as:

  • Device access restrictions in case of EMI default
  • Limited functionality mode
  • Remote unlock upon repayment completion

These features are governed by agreements between users, retailers, and lending partners.

6. Payments

All payments on the Platform are processed through secure third-party payment gateways (e.g., Razorpay).

We are not responsible for transaction failures due to:

  • Banking or network issues
  • Incorrect payment details entered by the user
  • Payment gateway downtime or technical errors
7. Intellectual Property

All content, software, design, trademarks, and technology on the Platform are the exclusive property of Newish Technology Pvt. Ltd.

Unauthorized copying, reproduction, or distribution is strictly prohibited.

8. Limitation of Liability

Newish Technology Pvt. Ltd. shall not be liable for:

  • Rejection of loan or credit applications by partner institutions
  • Changes in interest rates or loan terms by third-party lenders
  • Any indirect, incidental, or consequential damages
  • Temporary service interruptions or system downtime
9. Indemnity

You agree to indemnify and hold harmless Newish Technology Pvt. Ltd., its directors, employees, and partners from any claims, damages, liabilities, or expenses arising out of:

  • Your breach of these Terms
  • Your misuse of the Platform
  • Violation of any applicable laws or third-party rights
10. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without prior notice, in case of violation of these Terms or applicable laws.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising shall be subject to the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh, India.
